 All individuals, groups and organizations wishing to solicit and/or distribute literature (hereinafter collectively referred to as “solicit” or “solicitation”) at a Company store must apply for and receive a permit to do so. An applicant who receives a permit is a “Permittee” and these rules are applicable to the Permittee and its representatives. The Company may revise these rules at any time to adapt to new or changing circumstances.

Permit Application Process


1. The Company will issue permits on a first-come, first-served basis. Once a permit is issued for solicitation at a particular Store on a particular date, no other permits will be issued for that Store on that date. Permits, however, may be revoked as provided below.

2. The Company will not permit commercial activity on a for-profit basis. Commercial activity on a non-profit basis will not be permitted if it competes with the Company’s business.


3. The Company may issue a permit for solicitation at a particular Store, which solicitation shall be done pursuant to these Rules during the Store’s regular business hours on the day(s) permitted. No individual, group or organization shall be allowed to solicit more than seven days per calendar year at any one Store. The Company may decline to issue permits during periods of increased customer traffic, such as during the holiday seasons and special sales promotions.

4. Applications may be submitted no more than 60 days prior to the first solicitation date requested. Separate applications must be submitted for each day requested.

5. Applications must be completed on-line at http://www.raleys.com/www/feature/legal.jsp?featureid=1496104 for submission to the Raley’s Corporate Consumer Affairs Office.

6. All applicants must completely fill out the on-line application and read and agree to comply with these Rules. Permittees shall not distribute or sell any food item that is not manufactured or processed by a person or entity complying with the rules and regulations of all appropriate governmental agencies including without limitation the Food and Drug Administration and local public health agencies. Permittees shall not distribute or sell any sharp or dangerous items (e.g., buttons with pins) to minors nor distribute or sell any alcoholic beverages. Permittees shall not engage in any illegal activity, and shall abide by all governmental rules and regulations.

7. Applicants must apply at least seven business days (excluding weekends and federal & state holidays) prior to the date they wish to solicit in order for the Company to process the application.

8. Applicants will normally be informed of the status of their application(s) within four business days (excluding weekends and federal & state holidays) of receipt of the application(s). Applicants will receive the Company’s reply by e-mail. Permits, once granted, are non-transferable.

Solicitation Activity Guidelines and Code of Conduct

9. The Company’s parking lots are often crowded and the closer locations are reserved for customers. Please park in the outermost areas of the lot.

10. Any minor must be accompanied at all times by a responsible adult.

11. All solicitation activities must occur within a “solicitation area” that is at least ten feet from the Store entrance/exit and that does not obstruct pedestrian traffic or impair access to shopping carts or merchandise. The Manager on duty shall indicate to the Permittee the location of the solicitation area. The Company does not permit solicitation inside the Stores or at its Aisle 1 Fuel Stations.

12. No more than two adult representatives of Permittee may be within the solicitation area at any one time. Permittee may not impede the flow of pedestrian or vehicular traffic nor otherwise interrupt the operations of the Store. Under no circumstances may solicitation occur in parking lots or vehicle transit areas. Permittee(s) may not follow customers to or from their vehicles. Rather, Permittee(s) must remain within the designated solicitation area and let customers come to them.

13. Permittee and its representatives may not set up any permanent equipment of any kind. No lights, loud noisemaking devices or sound amplification equipment may be used. The Company also prohibits any display or device that might expose customers to danger or injury.

14. Permittee, at its own risk, may bring and sit behind a small portable table, which must be located within the solicitation area and which may display a sign identifying the organization. The table and any chairs must be removed when Permittee leaves for the day. Permittee may not use the Company’s equipment such as shopping carts, etc.

15. Permittee and its representatives are to be neatly dressed, clean, and at all times respectful in their contact with customers and employees. Shouting is not permitted.

16. Permittee and its representatives may not use “fighting words,” obscenities, grisly or gruesome displays, or highly inflammatory slogans likely to provoke a disturbance.

17. Store management can immediately revoke the permit, and direct Permittee and its representatives to vacate the premises, if Permittee or any of its representatives do not comply with these rules. A Permittee who violates these rules may not be allowed to solicit at the Company’s stores in the future.

18. At the end of the allotted time, Permittee must cease solicitation and/or distribution activities. Permittee must retrieve and remove any property, including handbills, from walkways adjacent to the Store. Permittee(s) should then report to the manager on duty for an inspection. Permittee may not retrieve any items that have been littered in parking lots or vehicle transit areas as such clean-up activities are dangerous and are only to be done by authorized personnel. If the Company must clean-up, or complete Permittee’s clean-up, Permittee will be liable for the Company’s actual cost of such clean-up.

19. A Permittee who solicits charitable donations should comply with the Better Business Bureau’s Standards for Charity Accountability.

20. The Company’s allowance of solicitation at its Stores is voluntary and does not diminish the Company’s rights to control the use of its premises.
